By accessing and using Black List, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Service Description

Black List is a platform where service providers can share reviews about problematic clients to help protect fellow professionals. We provide a database of reviews to help users make informed decisions.

3. User Accounts

3.1 Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior.

4. Review Guidelines

4.1 User Responsibility & Evidence

All reviews must be:

• Based on genuine experiences
• Factually accurate to the best of your knowledge
• Supported by evidence (photos when available)

Note: Black List does not verify the accuracy or authenticity of user-provided evidence and does not act as a mediator in disputes.

4.2 Content Standards

Reviews must NOT contain:

• False statements or intentional defamation
• Personal attacks, hate speech, or violent language
• Highly sensitive private data (Social Security Numbers, bank details, or medical records)
• Spam or promotional content
• Copyrighted material without permission

Users may include business-related contact information (such as phone numbers or addresses) only if it is directly relevant to the professional dispute being reported. Users assume all legal responsibility for the disclosure of such information.

4.3 Moderation

All reviews are subject to moderation. We reserve the right to reject, edit, or remove any review that violates these guidelines or is deemed inappropriate at our sole discretion.

5. Auto-Deletion Policy

Reviews are automatically deleted after 3 years. The status changes to "gray" indicating historical presence of an issue.

6. Intellectual Property

6.1 Your Content

You retain ownership of content you post, but grant us a license to use, display, and distribute it as part of our service.

6.2 Our Content

The Black List platform, design, and functionality are protected by copyright and other intellectual property laws.

7. Disclaimer of Warranties

Our service is provided "as is" without warranties of any kind. We do not guarantee:

• Accuracy or completeness of reviews
• Uninterrupted or error-free service
• That defects will be corrected

8. Limitation of Liability & Section 230 Immunity

Black List operates as an interactive computer service provider under 47 U.S.C. § 230. We are not the publisher or speaker of any information provided by another information content provider.

To the maximum extent permitted by law, Black List shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Any content posted by users, including any defamatory, offensive, or illegal conduct of other users

9. Indemnification

You agree to indemnify and hold harmless Black List from claims arising from:

• Your violation of these terms
• Your violation of any rights of another party
• Content you post on the platform

10. Dispute Resolution

If you have a dispute with another user, you agree to resolve it directly with that user. Black List is not responsible for disputes between users.

11. Reporting Violations

If you believe a review violates these terms or is defamatory, please contact us.

12. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms.

13. Governing Law & Jurisdiction

These terms are governed by the laws of the United States and the Commonwealth of Massachusetts. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Boston, Massachusetts.
